1. Agreement to Terms

Welcome to FitMagik. These Terms of Service ("Terms") govern your access to and use of the FitMagik website, virtual try-on service, and any related services (collectively, the "Service") operated by FitMagik ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

FitMagik provides a virtual try-on service that uses artificial intelligence to help users visualize how clothing and accessories might look on them. Our Service includes:

• Virtual try-on image generation
• Personal wardrobe management
• Try-on history tracking
• Affiliate shopping features

The generated images are AI-simulated representations and may not perfectly reflect real-world appearance. Results should be used for reference purposes only.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription Plans and Payments

4.1 Free and Paid Plans

We offer both free and paid subscription plans. Free plans have limited features and usage quotas. Paid plans provide additional features and higher usage limits as described on our pricing page.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method at the beginning of each billing cycle.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods.

4.4 Price Changes

We reserve the right to modify our prices with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload photos of other people without their consent
• Upload inappropriate, explicit, or adult content
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Service without permission
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Use the Service for any commercial purpose without our consent

6. User Content

6.1 Ownership

You retain ownership of the photos and content you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the Service to you.

6.2 Responsibility

You are solely responsible for the content you upload. You represent and warrant that you have all necessary rights to upload and use such content, and that it does not violate any third-party rights.

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we find objectionable, without prior notice.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by FitMagik and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

The AI-generated try-on images are provided for your personal, non-commercial use. You may share these images but may not sell or commercially exploit them.

8. Third-Party Links and Services

Our Service may contain links to third-party websites or services, including affiliate links to retailers. We are not responsible for the content, privacy policies, or practices of third-party sites. Your interactions with third-party services are governed by their respective terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results from the Service will be accurate or reliable
• The quality of any products or services obtained through the Service will meet your expectations
• Virtual try-on results will accurately represent actual appearance

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITMAGIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless FitMagik and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitMagik operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal resolution is not possible, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitMagik regarding the Service and supersede all prior agreements and understandings.
